Terms and Conditions


General

  1. The Promoter: The Coffee Club Franchising Company Pty Ltd (ACN 128 563 333), trading as The Coffee Club, Level 13, 199 Grey Street, South Bank QLD 4101.
  2. Participating Store: Any The Coffee Club restaurant or café in Australia, excluding Charlotte Street and Ryde Eastwood.
  3. By entering this competition, you are deemed to have read, understood, and accepted these terms and conditions (the "Terms").
  4. In the event of any inconsistency between these Terms and any other information regarding this competition, these Terms will prevail.

Who Can Enter

  1. Entry is open to all persons over the age of 18, except for employees and immediate families of the Promoter and its associated companies and agencies. “Immediate family” includes spouse, child or step-child (natural or by adoption), parent, step-parent, grandparent, sibling, uncle, aunt, niece, and nephew.
  2. The Promoter reserves the right to request proof of identity, residency, and/or entry validity from winners.
  3. Proof of identification, residency, and entry deemed suitable for verification is at the discretion of the Promoter. Failure to provide suitable proof will result in forfeiture of the prize.

When to Enter

  1. The competition commences at 12:01am (AEST) on Friday, 27 September 2024 and closes at 11:59pm (AEST) on Tuesday, 15 October 2024 (the "Promotional Period").
  2. Entries must be received by the Promoter before the competition close date and time. The time of entry is determined when the entry is received by the Promoter’s database.
  3. The Promoter accepts no responsibility for late, lost, or misdirected entries due to technical disruptions or other reasons.

How to Enter

  1. This is a game of chance. To enter:
  • Make an in-store purchase at a Participating Store; and
  • Scan your The Coffee Club Rewards App at the time of purchase during the Promotional Period (a "Qualifying Purchase").

  1. Only one entry is permitted per purchase.
  2. Entrants are responsible for ensuring their entry complies with these Terms.
  3. Any entry made on behalf of an entrant by a third party is invalid, unless assistance due to a disability is required.
  4. The Promoter reserves the right to:
  • Disqualify any entrant who tampers with the entry process or breaches these Terms.
  • Moderate or delete any incomplete, indecipherable, inappropriate, or offensive entries.

Draw and Notification

  1. A random draw will be conducted using a random generator at Level 13, 199 Grey Street, South Bank QLD 4101.
  2. The draw will take place at 10:00am AEST on Wednesday, 16 October 2024.
  3. The winner will be notified via their The Coffee Club Rewards App account.
  4. The winner will be advertised in accordance with relevant State or Territory regulations.
  5. If the winner does not accept the prize within 48 hours of notification, they will forfeit the prize.
  6. If the prize remains unclaimed, the Promoter may dispose of it at its discretion.
  7. The prize will be awarded to the individual who submitted the valid entry.
  8. All prize draw decisions are final and binding. No correspondence will be entered into.
  9. Delivery of the prize will be made within 28 days of acceptance.

The Prize

  1. The prize is one small coffee per day for 365 days, awarded as a coupon added to the winner’s The Coffee Club Rewards App account (the "Prize").
  2. The Prize will be loaded daily and expire at midnight.
  3. The Prize is redeemable only at Participating Stores.
  4. The Prize is non-transferable, non-exchangeable, and cannot be redeemed for cash.
  5. The winner may be required to sign a legal release in a form determined by the Promoter.
  6. Winners must:
  • Not sell their story or photographs to any media without prior written consent of the Promoter.
  • Comply with the Prize’s conditions of use.
  1. The Prize must be taken as stated. No compensation will be provided if the winner is unable to use the Prize.
  2. If the Prize is unavailable for any reason, the Promoter reserves the right to substitute the Prize for one of equal or greater value, subject to State or Territory legislation.

Entrant's Warranties

  1. By entering the competition, entrants:
  • Consent to the collection and use of their information for internal research and marketing activities.
  • Agree to be contacted for promotional purposes.
  • Consent to the use of their name and image in promotional material.
  • Transfer the ownership of their entry to the Promoter.
  • Acknowledge that no compensation will be provided for the above consents.

Liability

  1. Subject to State and Territory legislation, the Promoter reserves the right to cancel or amend the competition due to unforeseen events, such as vandalism, power failures, or pandemics.
  2. The winner acknowledges that the Promoter is not responsible for:
  • Unavailability or inaccessibility of services due to traffic congestion or other reasons.
  • Unauthorized human intervention.
  • Technical issues or malfunctions.
  • Loss, theft, or alteration of entries.
  • Any tax liability incurred by the winner.
  1. These conditions do not affect consumer rights under applicable protection laws.

Statutory Warranties

  1. The Promoter does not exclude any rights under the Australian Consumer Law.
  2. To the fullest extent permitted by law, the Promoter is not liable for any loss or damage suffered in connection with the competition, except for liabilities that cannot be excluded by law.
  3. Entrants agree to indemnify the Promoter for any loss or damage caused by their breach of these Terms.

Privacy

  1. Personal information collected for this competition will be handled in accordance with The Coffee Club’s Privacy Policy, available at www.coffeeclub.com.au.
  2. By entering, entrants agree to the use of their details for future promotional purposes.
  3. If entrants wish to update or delete their details, they can contact the Promoter through the website.

General

  1. The Promoter’s decisions are final and no correspondence will be entered into.
  2. This agreement is governed by the laws of Queensland, Australia, and the parties submit to its jurisdiction.
